These Terms govern your use of the Eini mobile app (iOS and Android) and the website eini.app (together, the "Service"). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, you must not use the Service.
The Service is operated by Marcelo Ferreira, sole proprietorship, Rathausenstrasse 17, 6032 Emmen, Switzerland ("Eini", "we", "us"). Contact: info@eini.app.
Eini helps with weekly meal planning and grocery shopping in Switzerland. Based on your inputs, it generates meal plans, recipes, shopping lists and savings estimates, and matches them with publicly available promotion data from Swiss retailers. The content is provided for information and everyday support only; it does not constitute an offer by any retailer, a guarantee of savings or a guarantee of availability.
Certain features require an account. You can register via email, Apple or Google. You must be at least 16 years old to create an account, or have the consent of a parent or legal guardian. You are responsible for the accuracy of the information you provide, the confidentiality of your credentials, and all activity under your account.
The core features of Eini are free. Premium features are available through an auto-renewing subscription ("Eini Premium") at CHF 1.00 per week, billed through the Apple App Store or Google Play.
Your mandatory statutory rights remain unaffected.
The Service may only be used for private, non-commercial purposes. You agree not to: (i) copy, distribute or commercially exploit content, data or features of the Service; (ii) scrape, harvest, extract or reverse engineer our algorithms, recipes, pricing or promotion data; (iii) use bots or automated tools to interact with the Service; (iv) interfere with the security or integrity of the Service; or (v) use the Service unlawfully.
The Service, including its databases, software, interface, texts, graphics and logos, is protected by intellectual property law. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own private purposes. "Eini" and the Eini logo are trademarks of the operator. All retailer and brand names and logos (such as Coop, Migros, Lidl, Aldi Suisse, Denner and Aligro) are owned by their respective holders and are used only for descriptive and referential purposes. Eini is an independent service and is not affiliated with, sponsored by or endorsed by these retailers.
You retain ownership of the content you enter in the Service (such as pantry items, preferences, lists and notes, or ideas you submit to us). You grant us a non-exclusive, worldwide, royalty-free licence to host, store, process and display this content solely to provide, maintain and improve the Service.
Meal plans, recipes, nutritional information and savings estimates are generated in part automatically. We make no guarantee as to the accuracy of nutritional information, the suitability of recipes for individual needs, or actual savings achieved.
Important: dietary and allergy filters are an aid, not a guarantee. Product recipes and ingredients can change. If you have allergies or intolerances, always check the label of the actual product before purchase and consumption. The Service does not provide medical or nutritional advice; for health-related questions, consult a qualified professional.
Prices and promotions shown in the Service are based on publicly available information from Swiss retailers, are set and published by those retailers, may change at any time and may contain errors for which we are not responsible. Only the information provided by the respective retailer at the point of sale is binding. You are responsible for verifying the final price before purchase.
We strive to keep the Service available without interruption but give no guarantee to that effect. We may modify, restrict or discontinue the Service or individual features at any time, including beta features made available for testing.
The Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, secure or accurate at all times, or that third-party prices, products or promotions are accurate or available.
To the maximum extent permitted by applicable law, we exclude all liability for indirect, incidental and consequential losses, loss of profit, loss of data, and losses resulting from reliance on third-party prices, promotions, recipes or nutritional information. Nothing in these Terms limits liability for unlawful intent or gross negligence, for death or personal injury caused by our negligence, or for any other liability that cannot be excluded under mandatory Swiss law. Where liability cannot be excluded, it is limited to the amounts you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.
For the iOS version of the app, Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce these Terms against you. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for it.
You may delete your account at any time in the app or by contacting info@eini.app. We may suspend or delete accounts where reasonably necessary, in particular in the event of a breach of these Terms, misuse or a security risk. Sections that by their nature should survive termination (including intellectual property, liability, governing law) survive.
We may update these Terms from time to time. We will post the new effective date and, where changes are material, provide reasonable prior notice in the app or by email. Continued use of the Service after changes take effect means you accept the updated Terms; if you do not accept them, you must stop using the Service.
These Terms are governed by Swiss substantive law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). Jurisdiction is determined by statutory provisions; the mandatory consumer venue under Art. 32 of the Swiss Code of Civil Procedure remains unaffected.
These Terms are published in German, French, Italian and English. In the event of any discrepancy between the language versions, the German version shall prevail.
